PAA: OPEN RECALL DISCLOSURE REQUIRED AFTER AUG. 27, 2018

Act 59 of 2018 takes effect on August 27, 2018 and requires all dealers to disclose to customers any open, unremedied recall using www.safercar.gov when a used vehicle is sold with an open recall.

 

At the time of sale, dealer personnel must utilize the VIN search on www.safercar.gov, print the recall report, provide it to the customer if the vehicle has a recall, and retain a copy of the information in the deal jacket.

 

Failure to provide the disclosure to customers at the time of sale is a violation of the law and could result in fines to the dealership.

Additionally, the Pennsylvania Automotive Association (PAA) recommends the use of the Acknowledgement Regarding Recalls Form available through Reynolds and Reynolds. To obtain this form, call (800) 344-0996.
