On August 7, 2026, the FTC issued a policy statement stating that it will not pursue discrimination claims based on disparate impact theories.
A disparate impact claim alleges that a business’ seemingly neutral policy or action can have a disproportionate effect on a protected group of consumers, based on statistical evidence.
The FTC has previously brought several enforcement actions against auto dealerships based on disparate impact theories.
